The xe đạp máy — a pedal bicycle with an electric assist motor — is Vietnam’s lightest powered two-wheeler category, and legally it is treated closer to a bicycle than to a motorbike. Under the definitions of the Law on Road Traffic Order and Safety (No. 36/2024/QH15), a pedal bike with an auxiliary electric motor that cuts out at 25 km/h and stops helping when the rider stops pedalling is classified outside the motorised categories.
What that classification means
No licence is required — there is no licence class for the category. No registration as a motor vehicle applies, though e-bike registration stickers apply in practice in some cities. The minimum age for riding one in traffic is 16, per the same age provision that governs mopeds.
What still applies
The helmet rule reaches further than the licensing rule. Article 31(3) of the law requires helmets for riders and passengers of motorised pedal bicycles — pedal e-bikes included — and the 400,000–600,000 VND fine band applies. The traffic rules apply in full: signals, direction of travel, sidewalk prohibition, pedestrian priority. A pedal-bike rider can be fined for counterflow riding exactly as a scooter rider can, in the band set for the category.
The 25 km/h line matters
The classification assumes the motor behaves as specified: assistance ending at 25 km/h, no throttle-only operation into motorbike speeds. A modified e-bike ridden at motorbike speed is a classification violation — the machine no longer matches its category, and enforcement treats the mismatch as riding the wrong class of vehicle.
For Hanoi riders
Pedal e-bikes are the popular choice for short student commutes and slow Old Quarter trips. They are also the category foreign visitors most often assume needs nothing at all — no helmet, no age check, no rules. The first assumption is the expensive one: helmets are compulsory, and checkpoints near tourist streets do check.
