The myth that helmets are only for “real motorbikes” is not just wrong — it is the most expensive wrong belief a moped rider can hold.
The rule
Article 33(2) of the Law on Road Traffic Order and Safety (No. 36/2024/QH15) requires riders and passengers of two- and three-wheel motorbikes and mopeds (xe gắn máy) — explicitly including electric mopeds — to wear helmets; Article 31(3) extends the duty to motorised pedal bicycles. Together they require everyone riding a powered two-wheeler that meet the national technical standard, fastened correctly. An unstrapped helmet is treated as no helmet.
The fine
Under Article 7(2) of Decree 168/2024/NĐ-CP, riding without a helmet, with an unfastened strap, or carrying a helmet-less passenger costs 400,000–600,000 VND — identical for mopeds and motorbikes. There is no “small bike” discount.
Why the rule is heavier than the fine
The physics do not scale with engine size. A fall at 35 km/h onto a kerb does the same head-injury maths whether the bike underneath was 50cc or 150cc, and head injuries remain the main cause of two-wheeler deaths in Vietnam. For teenage moped riders — statistically the most crash-prone group on the road — a certified, properly fitted helmet is the single highest-value piece of equipment on the bike.
Choosing and fitting
- Buy certified, not decorative. Novelty shells do not satisfy the standard; our helmet-standards article explains the marks to look for.
- Fit matters more than brand: no wobble, strap snug under the chin, eyes unobstructed — the fit guide covers the checks.
- A helmet that has taken a hard drop should be replaced, even if it looks fine.

Rental situations
