Children ride pillion in Vietnam every day — the school run is a pillar of Hanoi traffic — and the law carves the child cases out of the general passenger limits explicitly. Article 33 of the Law on Road Traffic Order and Safety (No. 36/2024/QH15) allows a motorbike to carry up to two people in defined situations, and a child travelling with an adult is one of them.
The passenger rule for children
The default is one passenger. Carrying two — three people on the bike — is permitted when the second is a child under 14 with an adult, alongside the other exceptions (medical transport, frail elderly or disabled persons, escorting a violator). A parent taking a child to school may legally carry the child plus no other adult; the exception does not open the door to a family of four.
The helmet rule for children
Every child on a motorbike needs a helmet meeting the national standard, fastened correctly. There is no general age exemption from wearing one — small children need properly sized helmets, which rental shops and markets stock. The narrow exemption that exists is about the helmetless-passenger fine: carrying someone without a helmet is not fined when that person is a child under 6 (or a patient being taken for medical care, or an escorted violator). The exemption is about the fine for the rider, not a statement that helmets are optional for small children.
Why this matters more for visitors
Foreign riders are less accustomed to carrying children in dense traffic and tend to underestimate two things: the child’s helmet (a full-size helmet does not protect a small head) and the stability cost of a shifting passenger. If a rental includes carrying a child, ask for a child-size helmet and accept the second-passenger rule’s shape: one adult, one child, one bike.
The fines
Carrying a passenger outside the permitted cases is 400,000–600,000 VND under Article 7(2) of Decree 168/2024/NĐ-CP; carrying three or more riders is a heavier violation with licence-point deduction, and any overload that contributes to a crash moves the case into the accident-causing band. The child exception keeps the school run legal — it does not keep three adults on one bike legal.
