“No licence needed” is the most misunderstood phrase in Vietnamese traffic law. Five myths do the rounds; here is what the statutes actually say.

Myth 1: “50cc means no rules apply”

False. The licence exemption is a single exemption. Moped riders follow every other rule — and Article 7 of Decree 168/2024/NĐ-CP fines mopeds at exactly the same levels as motorbikes for the same violations: red lights, wrong way, sidewalk riding, phone use, alcohol.

Myth 2: “Helmets are for bigger bikes”

False. Article 33(2) of Law 36/2024/QH15 requires a standard-compliant, fastened helmet for motorbike and moped riders and passengers, explicitly including electric mopeds. The fine for riding without one, or with an unstrapped strap, is 400,000–600,000 VND.

Myth 3: “Small bike, small fines”

False — see Myth 1. If anything the risk is higher: a slow bike is overtaken more often, and a 16-to-17-year-old who strays onto a 50cc-or-over motorbike commits a separate age offence (400,000–600,000 VND under Article 18(4)).

Myth 4: “Adults can dodge licence law by riding a 50cc”

Half true, and mostly irrelevant. An adult on a moped needs no licence — that part is real. But it does not dissolve the consequences of a crash: compulsory insurance duties, liability, and the same accident paperwork. Foreign visitors should read our licence article before assuming a moped solves an IDP problem.

Myth 5: “E-bikes are legally the same as 50cc bikes”

False. A pedal-type electric bicycle (xe đạp điện) is legally a bicycle — assistance must cut out when pedalling stops or at 25 km/h.
